1. About these terms

These terms apply to your use of wheelermotors.co.nz. By using the site, you agree to them. If you do not agree, please do not use the site.

These terms cover the website only. They do not govern the purchase of a vehicle, servicing or repair work, or a vehicle hire — those are covered by the separate agreement you sign for that transaction. Where these terms and a signed agreement conflict, the signed agreement applies.

2. Who we are

This site is operated by Wheeler Motor Company Limited (NZBN 9429035539285), 40 Disraeli Street, Addington, Christchurch 8024.

In these terms, "we", "us" and "our" mean Wheeler Motor Company Limited and the other WMC Group companies listed in our Privacy Policy.

3. Using the site

You may use this site to browse our vehicles and services, make enquiries, and access information we publish. You must not:

  • Use the site for any unlawful purpose, or in breach of these terms
  • Copy, scrape, harvest or systematically extract our listings, images or content
  • Attempt to gain unauthorised access to the site or any system connected to it
  • Interfere with the operation of the site, or introduce malicious code
  • Submit false information, or make an enquiry on someone else’s behalf without their authority

4. Vehicle listings and pricing

Our listings are an invitation to enquire, not an offer to sell. No contract is formed until we and you sign a written sale agreement.

We take care to keep listings accurate, but vehicles sell quickly and details change. Specifications, odometer readings, images, features and pricing are indicative and may contain errors or omissions. Images may not be of the specific vehicle. Where a price, specification or availability is stated incorrectly, we may correct it or withdraw the vehicle, and we are not obliged to sell at an incorrect price.

Prices are in New Zealand dollars and include GST unless stated otherwise. On-road costs, registration, delivery and accessories may be additional.

5. Finance calculators and repayment estimates

Any finance calculator or repayment figure on this site is an estimate only, provided for general information. It is not an offer of credit, an approval, or a quote, and it is not financial advice.

Estimates are based on example assumptions including an example interest rate, term, deposit and standard fees, which are stated alongside the figure. Your actual interest rate, fees and repayments will differ depending on your credit profile, the lender, the vehicle, and the lender’s responsible lending assessment.

Finance is provided by third-party lenders, subject to their approval and their terms and conditions. It may require vehicle security and insurance. We recommend you seek independent budgeting advice before applying.

6. Trade-in and valuation estimates

Any online valuation or trade-in estimate is indicative only and is based on the information you provide. It is not an offer to purchase your vehicle. Any actual offer is subject to physical inspection and to confirmation of ownership and any security interests registered against the vehicle.

7. Enquiries and bookings

When you submit an enquiry, a service booking or a repair booking request, we will respond as soon as we can. A booking is not confirmed until we confirm it directly with you. Submitting a request does not reserve a vehicle or a workshop slot.

8. Payment

You cannot purchase a vehicle or pay a deposit through this site. Any payment is arranged with us directly once a sale agreement is in place.

We accept payment in certain cryptocurrencies. Where you pay by cryptocurrency:

  • The price of the vehicle is agreed in New Zealand dollars. The amount of cryptocurrency payable is calculated by reference to that price at the time of the transaction.
  • Cryptocurrency values move quickly. Any conversion figure we give you is indicative until payment is completed, and you bear the risk of movement in value before that point.
  • Payment is treated as received when the transaction is confirmed and the funds are available to us, not when you initiate it.
  • Cryptocurrency transactions are generally irreversible. Any refund will be made in New Zealand dollars, based on the New Zealand dollar price agreed, and not in cryptocurrency.
  • We may require identity verification before accepting a cryptocurrency payment, and may decline a payment where we are not satisfied as to its source.

9. Your rights as a consumer

Nothing in these terms limits or excludes:

  • Your rights under the Consumer Guarantees Act 1993, where you acquire goods or services from us as a consumer
  • Your rights under the Fair Trading Act 1986
  • Any other rights that cannot lawfully be excluded

Where you acquire goods or services from us for the purposes of a business, and we agree in writing, the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 may be excluded to the extent permitted by law.

10. Our liability

Subject to clause 9, and to the extent permitted by law, we are not liable for any loss arising from your use of this site, or from reliance on information published on it, including where a listing, price or specification is inaccurate or out of date.

We do not guarantee that the site will be available without interruption, or that it will be free of errors or viruses.

11. Content and intellectual property

All content on this site — including text, photographs, video, logos and design — belongs to us or our licensors, and is protected by copyright and other intellectual property rights. You may view and print content for your own personal, non-commercial use. Any other use requires our written permission.

Our name, logos and brands may not be used without our written permission.

If you send us content — for example a photograph or a review — you confirm that you have the right to do so, and you give us permission to use it in connection with our business.

12. Links to other sites

Our site links to third-party sites, including listing platforms, review platforms, finance providers and insurers. We do not control those sites and are not responsible for their content, their products, or how they handle your information. Their own terms and privacy policies apply.

13. Privacy

Our Privacy Policy explains how we collect, use, hold and share personal information, including information collected through this site, cookies, analytics and online advertising. It forms part of these terms and is available at wheelermotors.co.nz.

14. Changes

We may change these terms at any time by publishing an updated version on this site. The version in force is the one published at the time you use the site. We may also change, suspend or withdraw any part of the site without notice.

15. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

Had an accident? What to do in the event of a traffic accident.

  • Make the accident scene safe.
  • Switch off vehicle.
  • Turn hazard lights on.
  • Notify Police if there are any injuries.
  • Keep everyone off the road and away from the accident.
  • Stay calm and do not make any rash decisions.
  • Exchange details with involved party - Registration number, Name, Insurance company details.
  • Obtain contact details from any witnesses of the accident, and the incident reference number should the police attend.
  • Do not drive your vehicle if it is not roadworthy.
  • Get the contact details of your towing company and provide them with your insurance company details.
  • Lodge a claim with your insurance company (repairs cannot take place until the claim number has been accepted by your insurance company and allocated).
  • Supply your insurance company with all details regarding the accident including the other party's details, and the police incident number.
  • Bring your vehicle into WMC Autobody if it is roadworthy. If it needs to be towed advise your insurance company or tow truck driver that you would like it to be repaired by WMC Autobody or Gary A Smith (panel beaters and car painters).
  • Once delivered to us the damage to the vehicle will then be assessed. Give you an estimate of how long it will take to repair and the cost.
  • As soon as we receive the vehicle you have peace of mind as we handle everything from here.
  • All work by WMC Autobody is guaranteed, we provide customers the reassurance that the vehicle will be restored to its original condition.
  • You will be contacted as soon as your vehicle has been repaired, inspected, cleaned and ready to pick up.
